1. About us

    The RENÉ CASSIN FOUNDATION – INSTITUT INTERNATIONAL DES DROITS DE L’HOMME,
    FONDATION RECONNUE D’UTILITÉ PUBLIQUE, with capital of 1984000.00 euros, headquartered at
    STRASBOURG (67000) 2 allée René Cassin 67000 STRASBOURG, registered under
    siret number 77886484300041. Declaration of activity registered under number 44670634667 with
    Préfet de la Région Grand Est and Certificate no. 721056 issued by Qualiopi. The Foundation is represented
    by Mr Emmanuel DECAUX (hereinafter the “Foundation”). The Foundation offers the following services
    : “online and face-to-face training”, “rental of training rooms”, “rental of
    offices”, “e-learning courses”. The Foundation is recognized as a public utility by virtue of the decree in
    Conseil d’Etat n°INTD1515586D dated December 11, 2015.
  2. Preamble

    These General Terms and Conditions of Sale (hereinafter referred to as the “GTCS”) form the sole basis of the
    commercial relationship between the parties.
    They govern the conditions under which the Foundation provides its Services to its
    professional customers who request them directly or on paper.
    They apply to all Services provided by the Foundation for all customers in the same
    category, irrespective of any clauses that may appear in a customer document, in particular its
    general terms and conditions of purchase.
    They are systematically communicated to any customer who requests them
    . All orders imply acceptance of the GCS.
  3. Definitions

    Customer means any person who places an order by direct contact or on paper; Order means any order placed by the Customer with a view to benefiting from the Foundation’s services; General Sales Conditions or GSC means the present document; Consumer means the buyer who is a natural person acting outside his professional activity; Professional means the purchaser, whether a legal entity or an individual, acting within the scope of his or her professional activity

    Services means all services offered by the Foundation; and
    Foundation means the René Cassin Foundation – International Institute of Human Rights, more
    amply referred to in Article I of these General Terms and Conditions of Sale.

  5. Services and prices

    Prices are those in force on the day the Order is placed, as set out on the
    internet site.
    The Foundation may grant the Customer price reductions, discounts and rebates depending on the
    number of Services ordered or the regularity of Orders, in accordance with the conditions
    set by the Foundation.
  6. Payment terms and conditions

    The price is payable in full on the day the order is placed.
    Payment can be made by: credit card, Paypal platform and, with prior agreement from
    Fondation, by bank transfer. In the latter case, bank charges are entirely at the customer’s expense
    .
  7. Performance of services

    The services ordered will be provided by:
    The Foundation
    The Foundation undertakes to comply as far as possible with the deadlines announced when the Order was placed.
    However, the Foundation cannot under any circumstances be held liable for delays in the provision of
    services caused by faults for which it is not responsible.
    The Foundation cannot be held liable for delays caused by
    force majeure, i.e. the occurrence of an unforeseeable, irresistible event
    beyond the Foundation’s control.
  8. Complaints

    For all orders placed, the Customer has the right to make a complaint within 30 days from
    of the end of the training course to the provision of the Service.
    To exercise this right of complaint, the Customer must send the Foundation, at the address
    administration@iidh.org, a statement in which he/she expresses his/her reservations and complaints,
    together with the relevant supporting documents.
    A complaint that does not comply with the conditions described above cannot be accepted.
  9. Right of withdrawal and cancellation conditions for
    ConsumersConsumers
    have a right of withdrawal within 15 working days of placing their order, except
    for products mentioned in article L. 221-28 of the French Consumer Code.
    To exercise this right of withdrawal, the Consumer should send a declaration to
    : administration@iidh.org.
    . The Consumer will be reimbursed for all fees paid for the provision of services within 14 days of the Foundation’s acknowledgement of the declaration of withdrawal by
    . Reimbursement will be made by
    the same means of payment as that used for purchase.
    However, if the service has already begun on the date the Foundation becomes aware of
    retraction, the value corresponding to the service already provided will be
    deducted from the reimbursement. The latter will be made by the same means of payment as for the purchase.
    The conditions for cancellation of each training course at the customer’s initiative are specified for each
    action directly on the Foundation’s website.
  10. Legal warranties

    Services supplied to Consumers are guaranteed in accordance with the legal provisions of the
    Consumer Code and the Civil Code.
  11. Personal data processing

    The Customer’s purchase may entail the processing of his/her personal data. If the Customer
    refuses the processing of his/her data, he/she is asked to refrain from using the services of the
    Foundation. This processing of personal data is carried out in compliance with the General Data Protection Regulation
    2016/679 of April 27, 2016. In accordance with Article 6 of Regulation (EU) 2016/679 of April 27, 2016 “on the protection of
    natural persons with regard to the processing of personal data”, the Customer consents
    to the processing (collection, recording, storage, consultation, use, communication) of
    his personal data by the René Cassin Foundation in order to enable, in particular, the
    management of the service ordered and access to activities. The Customer’s data will be kept
    for as long as is necessary for the purpose of processing, before being archived
    in accordance with the legal time limits applicable to contract management and invoicing.
    The customer acknowledges that, in accordance with the provisions of articles 15, 16, 17, 18 and
    21 of the aforementioned regulation, he or she has the right to access data concerning him or her, the right to rectify it, the
    right to object to it, the right to limit the processing of his or her data, and the right to
    the deletion of his or her data. To exercise these rights, or in case of difficulty, please contact
    Fondation René Cassin, by e-mail (administration@iidh.org).

    Lastly, and in accordance with Article 7 of the aforementioned Regulation, the service provider is informed of the possibility of
    withdrawing this consent at any time, after informing the René Cassin Foundation, by e-mail to
    the aforementioned address. In addition, in accordance with the French Data Protection Act of January 6, 1978, the Customer has the right, at any
    time, to query, access, rectify, modify and oppose
    all of his/her personal data by writing, by post and providing proof of identity, to
    at the following address: administration@iidh.org. This personal data is required to process orders and to improve
    the services offered by the Foundation.

  12. Sharing collected data

    The Foundation may use third-party companies to carry out certain operations. The customer accepts that third-party companies may have access to his/her data to enable
    the completion of his/her order. These third-party companies only have access to the data collected in order to carry out a specific task
    . The Foundation remains responsible for the processing of this data. In addition, the Customer may receive information or commercial offers from
    the Foundation or its partners. The Customer may at any time refuse to receive such commercial offers by writing to
    at the Foundation’s address given above. In addition, Customer information may be passed on to third parties without the Customer’s express prior consent for the following purposes:
    to comply with the law
    to protect any person against serious bodily harm or even
    death to combat fraud or attacks on the Foundation or its
    users to protect the Foundation’s property rights.

  13. Data protection

    The Foundation ensures an appropriate level of security proportionate to the risks incurred and to
    their probability, in accordance with the General Data Protection Regulation 2016/679 of 27
    April 2016.
    However, these measures in no way constitute a guarantee and do not commit the Foundation to a
    obligationof result regarding data security.
  14. Cookies

    To enable its Users to enjoy optimal browsing on the Site and better
    operation of the various interfaces and applications, the Foundation may install a
    cookie on the User’s computer. This cookie is used to store information relating to
    browsing on the Site, as well as any data entered by Users (in particular
    searches, login, email, password).
    The User expressly authorizes the Foundation to place a “cookie” file (
    ) on the User’s hard disk.
    The User may block, modify the retention period, or delete this
    cookie via the interface of his/her browser. If the systematic deactivation of cookies on the User’s
    browser prevents him/her from using certain services or functionalities of the Site, this malfunction
    shall in no way constitute damage for the member, who shall not be entitled to claim any
    indemnity as a result.
  15. Changes

    The information contained in the Foundation’s catalogs, prospectuses and price lists is given for information only
    and may be revised at any time.
    The Foundation is entitled to make any changes it deems necessary.
    When placing an Order, the Customer is subject to the stipulations set out in the General Terms and Conditions of Sale in force
    at the time the Order is placed.
  16. Intellectual property

    The brand, logo and graphic charter are registered trademarks owned
    exclusively by the Foundation. Any dissemination, exploitation, representation or reproduction, whether
    partial or complete, without the express authorization of the said Foundation will expose the offender to
    civil and criminal proceedings.
  17. Thelaw governing the GTCS is French law. Any dispute that may arise between the Foundation and a
    Customer during the execution of the GTCS will be subject to an attempt at amicable resolution. Failing this,
    disputes will be referred to the competent common law courts.
  18. Customer acceptance

    The Customer expressly accepts the GTC. He declares that he is familiar with them and waives the right to invoke
    any other document, in particular his own general terms and conditions of purchase.
